Problem With Payroll At Work / SOLVED

Hey all , was wondering if I could have some advice on a problem at work .

I recently changed jobs and started my new job on the 8th of October this year . My previous employer withheld my P45 and I was late receiving it , hence I was late in giving it to my new employer .

I mentioned I could fill out a P46 to get myself on the company's payroll system in the meantime , however , they didn't want to , and wouldn't let me go down this route so I had to wait .

This led to myself as an employee not being insured to work in the premises for just over a week also , so I couldn't be at work , much to my annoyance as I wanted to get started .

The problem I have now is that payday was on the 25th of October . Due to their insistence that I wait for my P45 , I didn't make the cut for payroll . So I decided to chase them up , and ask for a forwarding payment to be put into my account . This was all good for a while , they said to me I would have a payment on the 31st of October . Awesome I thought .

This payment hasn't arrived as my bank has said it will take 5 working days to clear . Technically this money should be in on wednesday this week at some point . This wasn't good enough for me , so I chased them up again and they agreed to put in another quick payment so I could actually get to work . This was due to be in my account at 5pm yesterday , it isn't there . And now I have to phone my work yet again ( in 5 hours time or so ) , to explain that the payment that they assured me would be in , just plainly isn't .

Yesterday my bosses were breathing down my neck , and getting annoyed as I cannot travel the 80 mile round trip to my work everyday as I have no money for fuel to get to my new job .

My question is ; What should I do about this ? Without this advance paid into my account i'm stuck . Should I seek '' Citizens Advice '' , in case they try to fire me over it also ? Do they have any grounds to fire me ?

Any help from someone in the know would be very appreciated .

Did they say that you are on a trial period/phrobation?

If so yes they can and probably will dismiss you if you fail to turn up to work, although every company is different.

Have you explained to them the problem and the effects it will have?

Have you any friends/family that could lend you some cash/credit card?

I also dont understand a company paying you before you start working for them.

It is probably a 6 month trial I would imagine .... That is true .

Yeah , they are aware of this problem and the effects . It all stems back to the P46 issue . If they would've accepted a P46 as soon as I started , this whole thing wouldn't have happened as I would be on the payroll by now ....

Nope , all avenues for cash are exhausted .

Like I say , I started on the 8th , was also told I would be on full pay from that date . So they are '' Due '' me wages in that sense . I'm not demanding anything I haven't earned ... Just need to see it asap 👍
 
Is there a possibility that a worker from the company can give you a lift? Only for a short period?

The company knew that your previous employer held your P45 (for whatever reason, I don't know) so they should have allowed you to have done a P46 or inputted your information to their payroll system as soon as possible anyway, as its only when it comes to April that any issues with that would arise (which it shouldn't once all the paperwork came through).

Its an odd situation as they had said that they will pay you for a certain date but they hadn't. So you may need to sit down with the manager and go through the reasons why you require them to pay you for your hours worked and could they do it immediately.

You can go and ask at the Citizen's Advice service just to be given more information about what you can and cannot do, legally.

Although I assume that someone got crossed wires at some point at that company.
 
As for as any payment agreement that you have come up with outside of the standard employee method, that isn't signed. Doesn't mean anything. Basically they have agreed to do you a favour but at anytime they can withdraw that favour. If you had been doing this for a considerable length of time it may be different but not in this present state.
As for the P45. I have never heard of a company refusing to accept you on their payroll without one. Without a P45 you get issued with an emergency tax code from the tax office until they sort it out. It may be slightly more work for your companies accountant to set this in motion, but she/he doesn't do anything extra after that. They get issued with your tax code and thats it. I have had this several times in the past when it simply wasn't an option to get my P45. You could always sort this out yourself though. You could ring the tax office tell them you have not had your p45 tell them what your company has said and they should give you a tax code. You may pay more tax with this emergency code but you will get it back.

As for speaking to the CA, it's not that their bad. It's that they are painfully slow, and very very busy and they don't all specialise. Try talking to a free law firm. Most cities and towns in the UK have them though more and more are closing. They will offer you free indepentent advise from a specialist in employment law.
Your company refusing to put you on the payroll, really does not sound right to me.
 
Thanks for the great advice guys , I've got this issue sorted now and I'm back to work again tomorrow .
