Racism Lawsuit in AL

Hmmmm... it's a doubtful case. Of course it is wrong to use price discrimination on race, but when looking at a person's hair I'm sure any hair dresser knows how much time will have to be invested into it. Since many black women have curly hair it's safe to assume that a different treatment will be necessary.

Of course the USA is the country with THE most ridiculous justice system known to man, as the Stella Awards have proved in the past, so you should be careful speaking out on this topic. I wouldn't be surprised if this is another broke unemployed cow trying to get money out of someone who is running a fair business and didn't exactly spell out which criteria they base their prices on.

"Dillard's does not charge different prices based upon the race of the customer," the company said in a statement. "Prices for salon services are based upon the level of experience of the stylist, degree of service, amount of time required and the cost of materials provided to the customer."

That is very standard procedure in any hair salon. I have long straight hair. It can be difficult for hair stylists to work with. I understand that some hair takes longer to style and that I could be charged extra. The stylist could work on me in the time it takes to normally work on two clients.

"It's a whole new way of cutting. Not everyone can do it. I cut both and I do it pretty fast, but I grew up in this business," McArthur said.

Very true. My mom was trained as a stylist. However, she has no idea how to cut the very tight curls. Honestly, a person who is trained to cut hair usally learns the proper technique for someone of their own ethnic background. It is easier to understand the hair of someone that is similar to your hair type.

Still, civil-rights law expert Robert Belton said Dillard's could be in trouble if the pricing is determined solely on race, and not on other factors, like amount or style of hair.

"If they're saying that because of a person's color that it takes more time, then it's obvious that it's race," said Belton, a professor at Vanderbilt University Law School.

That's saying a car service station should mark all of their services with one price. No matter what is wrong with your car...we'll fix it for $49.99. Well, that is a rip-off to anyone who is getting an oil change. And $49.99 is a bargain for anyone with major car problems.

The same goes for this case. If I wanted to get my hair cut, $49.99 would be ridiculous. If I wanted to dye my hair, $49.99 would be a bargain. Different services, hair types, length, period of time, and stylist's experience should all factor into the price.
