What to do in this situation....

Over the past week, my wife and I have been trying to get her stolen phone back from a restaurant right up the street. I will give a list of events and I would like some opinions as to what step to take next

June 18th: 11pm - Left wifes work phone at the table at restaurant.

June 19th: 2:30am - Return to the restaurant and inquire with Bouncer 1 about any lost phones. After speaking with Manager 1 He says all have been accounted for, maybe try in the morning.

June 19th: 1:00pm - Ask Manager 2 about a missing phone and he says that he was given a lost phone by our server and put it under the host/hostess desk but left before the night club began. Upon searching for the phone, unable to locate it. I leave my contact information with Manager 2 and Hostess 1.

June 20th: Return in the morning and speak with Manager 2 and Hostess 1 again about the phone, and see if their is any new information. Manager 2 says that a security camera captures Bouncer 2 taking a phone from under the host/hostess desk and never return it to the location. Sometime in the day I return to the store and speak with Manager 1 who was told of my situation by Manager 2 and that they are trying to get in contact with Bouncer 2 who is apparently not in town. Told to come back Thursday

June 23rd: Ask again about the phone and Manager 2 says no new information. Manager 2 shows me security camera footage and shows Bounder 2 taking phone from desk June 19th at 2:45am but never returning it to the location. Says that Manager 1 is still trying to contact Bouncer 2 but no information. Manager 2 says that they will pay for the phone.

June 26th: 11:30am - Return to the front desk and only new information is that Bouncer 2 is apparently UPS shipping the phone that was lift in Bouncer 2 significant others vehicle. I explain that I honestly doubt its return after being missing a week and that we are going to have to buy a new phone.

June 26th: 3:00pm - Go to phone company and the cheapest way to solve issue is adding a new line (plus a new line for me....something we have been meaning to do...) to get a phone at a discount. I ask about return policy and it is 14 days, 3 days to get almost everything back (activation and other fees) in return. We get my wife the exact same phone as before. Return to restaurant with reciept and leave with $150 in cash. I do tell them to call in case phone does arrive.

June 27th: Have since received 2 calls from Manager 1 saying they have the phone and wants to exchange for the $150 Manager 2 gave us on the 26th.

I have not returned his call.

One issue is the phone. It was out of our posession for a whole week, apparently in Bouncer 2's significant others vehicle. In my personal opinion. I believe that Bouncer 2 took the phone after overhearing my conversation with Bouncer 1 and gave it to the sig. other. However, once the footage was brough up, decides to return the phone. Yet what happened to the phone over that week?

Another issue is morality. I feel like I should take the phone back and return the cash because I feel like I said that I would upon its return. Then, in turn, have to run around and try and solve all the issues with returning the new phones.

Another issue is my wife. She wants to be done with the whole situation and doesnt want to hassle with this anymore. She believes something happened to the phone while it was gone. She did want it back originally but really for the contacts that were in the phone.

Finally, in a parallel universe, the restaurant managers and staff could have just not cared about the phone and that it was lost. Yet, they offered to try and help us find it. Granted, I was always the one to ask for any new information

We love this restaurant and this has really hampered our image of it. We can walk there and almost see it from our home. If we do not retun the money we can count on never going there again but even if we do, it will be a long time.

Any thoughts?

They had to get a new one from storage in the back when we went yesterday so it isnt anything new.

Bouncer 2 claims (thru Manager 2) "didnt steal it but just forgot to put it back" Without talking to Bouncer 2 directly, I can only assume he stole it or that he actually didnt mean to take it. However, the FACT is that Bouncer 2 should have never been behind the counter in the first place.
 
I would return money & get original phone back, just for the sake of pointing it out to "bouncer2" that he screwed up miserably!

I would however, since it's caught on tape, turn him in to the police.

Can you get phone records off your phone company? Id try doing that, and if they did use it, I would call them back and tell tham that you will be deducting the fees incurred from the $150 they gave you.

Also I would make sure to test it and see that it works OK before taking it or giving him his money back.

Like you said, it all comes down to the restaurant. You guys love it, and if things go down the wront path, you might not be able to go back.
 
^ Thats the thing. No extra charges occured on the account. The phone was nearly dead when lost and only one call was made after it was lost at 3am to my mother-in-law but no message was left.

Concenses seems to be to return the money for the phone. Yet part of me wants the phone back and to wait a week to give them the $150 in case it doesnt work. I need to wait and see the phone before I do anything further.
 
Since you seem to be regulars, talk to the managers and see if they would let you take the phone back, test it for a week & then return the money if everything's a-ok.

Communication is usually the best answer to problems like these :)
 
Nope, no calls with the phone (it was nearly dead when we lost it) except for 3:00am after it was in Bouncer 2 posession. We called the phone pver the next 2 days and it would ring and then go to voicemail as if it was still on, yet after the 2 days it went straight to voicemail and is like that since then.

That doesnt mean there wasn't intent to sell the device (but also doesnt mean there WAS intent either)

And yes, communication is they key here. I would think that they would be accomodiationg to see if it works within a week of having it, I just need to investigate the phone and see the next steps to take.
 
I say return the money and get the old phone. They held up their end of the bargain by paying you for it, something they didn't have to do, so its only right to return the favor. Your beef is with bouncer 2, not the resturaunt, so why punish them? If anything, they should be praised for helping you out as much as they did.

One thing to make sure of though...no matter what, make sure to check the activity during the week it was in his hands to make sure there isn't any calls (long distance or whatever) that he may have made that you would get stuck paying for since the phone wasn't reported stolen and deactivated.
 
I would return the $150, as I firmly believe in karma when it comes to money.

Perhaps those managers would service you better next time after you give the cash back.
