Nintendo Wins Suit Against the Japanese "Real Life Mario Kart" Company

Haha, I actually did this last year when I was in Tokyo with two friends. The Mario character experience is only a small part of it although it is a pretty cool gimmick. But the real joy of the entire thing is driving go karts on public city roads... I kept telling myself, "how am I allowed to do this?" We went later in the day near twilight, so we got to experience some of it in daytime but most of it at night, which is the definitive experience imo with all the lights and neon signs. Very surreal and I'm glad I did it while I had the chance. Looks like they could still keep the go kart service up without Mario characters, but perhaps they might take too big of a hit paying the damages and also lose the attraction. But yeah, it was certainly one of the highlights to my trip to Japan last year and I was able to record a good chunk of it with a head-mounted GoPro.

How about instead of a lawsuit make a deal about using the costumes? Nintendo is only going the hard way into stuff I feel.

Marikart obviously dont wanted to or planning pay any licensing. Nintendo probably has a long list of requirements and a high price to get a license. I dont know the details but normally Nintendo's lawyers already wrote them a cease and desist of some kind. They only start a lawsuit after multiple warnings. Lawyers etc. are incredibly expensive.

Then the kart group should have asked permission to the IP, that's how these things work. I'm having trouble understanding why people see Nintendo as the bad guy.

Wow rare Roger post, and one I can easily agree with as far as Bowsette goes. I do agree though that I doubt it infringed on Nintendo's marketing.

It isn’t about infringing to sell copies of MARIO kart. It is profiting off your intellectual property without permission. It is like me profiting on Roger the horserides on the back your Roger the horse name without your permission.
 
With a market cap of 60B USD I would also protect my intellectual property. How would you like it if I started profiting off your name without consent.
I would see it as free advertisement, they are the only console company that copyright flags all their games on youtube as well that has harmed them from free exposure.

I also disagree with those practices, but that is their own choice to not accept that free exposure. But they aren’t comparable. Marikart would have not be in business if Nintendo didn’t exist.
 
Both are terrible. Only difference is EA doesn't make consoles (to my knowledge).

Sony does. Microsoft does. How about Atari? Sega?

Seriously, a restrictive Youtube policy doesn't really rank compared to even some of the recent stuff like, say, Sony's numerous lapses in customer data security. I'd be more worried about that than not being able to become an internet superstar from my mad Mario skillz. If your idea of "worst console company ever" is based on that Youtube policy, you should read up on the history of consoles some more. You'll be shocked at some of the stuff that has gone on. Look up the video game crash of 1983 and all the bollocks that led to that catastrophe.

Companies abusing Youtube for profit is pretty much par for the course these days. If anything, Nintendo is one of the clearest about it's policy and how one can work within it, instead of simply claiming or striking videos willy nilly. I think their policy is dumb because they're denying themselves free advertising, but given the systems on Youtube are the way they are Nintendo can kinda do what they like.
