Then again, the BMW is a BMW designed McLaren and uses the McLaren name while the SLR is a McLaren designed Merc that uses the McLaren name. So effctively, neither is actual a McLaren and in my opinion, whichever category one is in the other should go in. So I think because of the clarity issues, I think both should be legal but again that is just me.
BMW provided the engine for the F1 and a lot of financial backing when McLaren wanted to field cars in the BPR series in the mid-90's, but the GTR is still a McLaren vehicle; it will have a unique, England-based VIN, for example. The racer's inclusion in GT4 as a BMW was a sly work-around by PD to get at least some form of the F1 in the game. The McMerc, despite having McLaren in the name, still has a Mercedes-based VIN. It was built at McLaren's Woking facility, and uses a fair amount of their expertise, but that's as far as the connection goes.
