Depends where in the world you are. Tokyo can be very confusing. Each area has it's own rules and they're seldom displayed. I tend to just do as the locals do, but I have seen some people just ignore the no smoking signs.

And worse case you are told to move, which unless raining isn't really the end of the world.

That mission is the entire reason I modded my GTA. Slow time, pick them off with minigun speed double pistols. That'll teach you to be badly coded.

If you just go a couple of metres away Smoke'll kill them easily.
But you're right, the game does have some quirks.
