As a fellow smoker, I know what its like to drop a smoke while driving, but next time just pull over to find the fallen smoke...

This so much. I smoke too (well switch to e cigs yesterday) but especially the locality you were in this would have been the wise choice.

As for fleeing the spot, I agree with the police. You should have stayed there with your car and waited. Now you know for the next time. Glad you are okay.

Carlos: don't go outside your country. While I am not a fan what happens everywhere, all your neighbor countries have drugwipe test. Even after weeks it still detects, has a 20% failure rate (false positive- neg) , then you go for a blood sample, car immobilized, and in Germany as stranger for exemple you pay a deposit of 750€. If you bloodlevel is high enough to assume you smoke regulary, goodbye 750€, hello felony treatment. It's ridiculous I know. But Germany, Belgium, Luxemburg, France all have them. That's why I stopped. I can't risk my premit let alone get my car impounded

Ow wow :scared: Did not know that. Thank you 👍 I wouldn't go across with anything on me, I did however went over the border while having smoked a few hours before. Didn't think I would get in a lot of troubles with that since we have so many drugs tourists from Belgium and France.. The Germany part does scare me though! Especially if you know how kind Dutch officers are. Me and a friend were smoking along side a departure lane (airport), watching some planes go by, smoking... Then out of the blue, a cop car and customs car. Woops! He turned my car inside out, but didn't found anything more than what I said I had in the car, and let me keep it.. Pretty awesome that was.

Then Belgium followed (they have signs on the Road to Liege), then Luxemburg followed. Then I knew it was time to stop as I cherrish driving too much(stopped 2 weeks ago).
They still need to stop you and... chances are slim, but if it happens, you're treated like a criminal :(.

Worst is the test have such a high failure rate. If alcohol test would have that failure rate they would never been used due to pressure from people and lobbies. Stoners don't have a lobby and aren't taken seriously. It's really sad, our society in which a real harmful poison is socially and legally accepeted and a lesser evil is not.

Did you know electric cigarrettes are forbidden in Germany :ouch: real cigarettes are not. Logic:crazy:
 
First, that is clearly irresponsible behavior you used in your example so it really doesn't work well.

Second, not all drugs have addiction issues. Weed and acid are far less addictive than alcohol or tobacco for example. So I'm curious what drugs you're father is dying from.

From what I remember him telling me, he's dying from acid and alcohol. There may have been a few other drugs here and there that he was addicted to when he was younger but those two are the main ones that I'm sure of.
 
It's all well and good saying "You should have pulled over first" etc but in the heat of the moment, alcohol or no people are prone to making instinctive reactions without thinking - with a smoke possibly causing a fire or at least burning the upholstery you want to fix the problem as soon as possible.
(But really, do try to remember to pull over any time a distraction like this is present, especially so in the wet.)

Sorry to hear about your Corvette and your chargers - but at least you're okay.

I could understand people being against any drug use when they never experienced someone in their lifes using it with control. And it's getting a lot of bad attention however now legalized overseas.. It's almost like the table is flipping... But it's true 'we' are not getting listened to and sure not taken seriously.

And wait whut? I don't know the tax on cigarettes in Germany but they're probably scared to lose income on them? I know taxes are crazy here :scared:

Simple fix for that.

Don't smoke in good expensive cars.

Buy an old bomb and smoke in that all you want.

I know i do not want to own a car that where the owner has smoked in it, unless i can get a major discount of the asking price since i'll have to clean the whole interior with a wet vac and all.

Plus the driving away from the accident, does that mean if you have a tiny accident by yourself then you still need to wait for the police. I'm guessing you didn't knock either the telephone or hyrant over, so why would you need to wait around. I know in the UK you arn't required to wait for police unless anyone is injured or there is damaged to a third persons property and that third person isn't present.
 
In Georgia, you can be charged with DUI despite the fact that your BAC was less than .08. You can also be charged with DUI in Georgia if you refuse to allow the state to test your blood, breath, or urine. If your BAC was less than .08 or you refused the blood, breath, or urine test and the state decides to go forward with the charge of DUI against you, you will be charged under Georgia's DUI less safe law.

It's a Georgia thing. Honestly though, regardless of BAC limit, if you get into an accident like that in any state you could be looking at a DUI charge if anything is in your system.

That is really ludicrous, so you could have 0.001 BAC and still be done for DUI whether or not it was an actual contributing factor to the incident or not, ludicrious.

Obviously at that point it's going to be at the discretion of the responding Police officer, but a silly accident on what should be a low speed street given the circumstances isn't going to help make a great case for not being impaired.

Exactly, and some people have very little tolerance for alcohol and become impaired at a much lower BAC than others.

I don't know how it is in UK, another member could clarify, but even if you are under the limit and are involved in an accident, the alcohol is a factor.
the 0.8 or 0.5 is not a safe pass to not get a DUI. And I am pretty sure it is the same in the UK.

My experience from watching cop shows is that they breathalyze everyone who is involved in an accident and if it was your fault and you blew below the limit then it is always put as driving without due care and attention and never drink driving.

Just done a quick google and the government website has nothing about drink driving charges if below the limit.

Either term means that the driver was operating a vehicle while impaired by some type of chemical.

Blood alcohol content (BAC), tested by a breath, urine, or blood sample, will determine the penalties to be charged for an alcohol-related DUI offense. In Georgia, a BAC of 0.08% or higher automatically counts as a DUI.

Note, however, that you can get a DUI with a BAC of lower than 0.08%. All the officer has to do is observe that your ability to drive is impaired, and on go the handcuffs.

Also, while alcohol and illegal drugs are clearly grounds for a DUI, legitimately prescribed or over-the counter medications can also get you in trouble. If they affect your ability to drive―and a lot of them do―you could be arrested.

Of course, it helps the state's case if the officer collects chemical evidence that your BAC was over 0.08%. To make it easier for the police to do this, Georgia (like most other states) has a law that punishes drivers who refuse to take a chemical test.

Called the Administrative License Suspension Law (also known as implied consent), it works like this: If you are pulled over and a police officer asks you to submit to a breath, blood, or urine test to determine your BAC, and if you refuse, your license may be suspended for one year.

Ah, I see. I still think that it is a slightly stupid system to have(I think the limit should be the limit otherwise it makes a law rather subjective.) , however I understand the logic behind it.

Considering acid has virtually no toxicity to humans I find this surprising. I don't believe it is possible to even overdose on acid to where it kills you physically, psychologically is a different story but coming back from a trip is just a function of time. It also isn't addictive physiologically, unlike alcohol.

Alcohol on the other hand is extremely destructive to the body when consumed out of moderation. It has severe addiction and dependency risks as well.

Acid isn't killing your father, alcoholism is.

Lbsf1, the fact is the DUI point is extremely arbitrary to begin with. I know plenty of people that are sober at 0.08 and plenty that are drunk at 0.04.
 
Let me be completely clear. Being a bartender now for a few years, I am a pretty good judge on when someone is/isn't impaired to drive. Hell, I can go to jail for letting you drive. I would have given me my keys. I wasn't "impaired" in the least. I didn't even have a smidge of a buzz even coming.

I think the GSP officer was just brutally stern on me. C'mon man, you breathalyze me and see I'm under. You see I'm not red eyed and staggering. You can fricking see my car in my driveway from where the accident was. Let me go home to my wrecked investment and get what you could say is REALLY drunk. He just didn't see it my way. :)

Edit : And I have no priors. None. Zero. Zippity do dah. No warnings. No tickets. Nothing. I really didn't see the cuffs coming and me spending xmas eve into xmas morning behind bars. When I did get out and make it home, I did sit with my garage open with friends staring at it over a few beers and maybe a shot or two of Wild Turkey. :)

At least you may have learned something; what I have from similar deviation of attention from driving (while driving) is it's always wiser to stop the vehicle, and then buckle that unbuckled seatbelt, or scrabble for the fallen butt, or look for the dropped condom, beer, or phone.

Shame about the car - you're lucky to actually own and enjoy one.

At least you may have learned something; what I have from similar deviation of attention from driving (while driving) is it's always wiser to stop the vehicle, and then buckle that unbuckled seatbelt, or scrabble for the fallen butt, or look for the dropped condom, beer, or phone.

Shame about the car - you're lucky to actually own and enjoy one.

I'm the same, any time I forget my belt or need to do extensive fiddling with my audio equipment I'll pull over and focus on that task.

It's just never worth the risk - no matter what kind of rush you're in; at least that's how I feel.
