Will apple get sued over its Ipad mini?

We have read in the news how they are suing samsung over the use of the pinch zoom.

For some unknown reason to the world, apple was some how copyrighted and everyday action and are suing there greatest rival which could derail the apple flavored gravy boat.

But since android tablet makers have made 7" versions so people can still use a good tablet that does the same things as their bigger brothers only with a smaller footprint in screen size and power usage.

Due to this popularity apple made the iPad mini something Steve Jobs said is no good.

So will apple now get sued for making a 7" tablet after all, if you can sue someone for a action of the finger, why not the size of a tablet, especially since you mainly know that 7" tablets are android based.
 
I don't think a company can "own" a size of a device. Or TV companies would be sueing left, right and centre.
 
Then how can a company copyright a action people have been doing before apple has been founded?

That is what they are suing Samsung for.
 
Maybe because it is a specific action to interact with the device, and it is something Apple thought of (in regards to zooming) and its associated with Apple, and they don't want Samsung to use it.
 
^The Zoom function existed well before Apple on Pc multi-touchscreens, it wasn't patented. That's all. Apple copied it, made a patent and sued everyone later on.

If google or samsung would have a patent on 7 inch tablets with round borders a screen behind a transparent glass and coloured icons, than yes.

But I doubt it has been patented like that from an Android Manufactor.

(did you get the pun? apart from the size factor, Apple Ipad has a design patent with the above cited criterias! What has the world come to?)

Patents are all good if it doesn't hinder developement of a sector, but Apple exagerates a lot with it.
But they should do how they feel, I think after the departure of Steve Jobs, Apple will go down sooner or later.

Did you see the new add, claiming physics are just guidelines... Would never have been done under Jobs...

apple was a genius in making things a bit more approchable and in marketing.
Otherwise it was mediocre hardware in jnice packaging for a crazy price.

I've already decided that I will not buy any more apple products since they've become a patent bully. It would upset me if someone else sued over this.

Patents and copyrights are terrible.
 
Also the are doing it for "rounded rectangles" as well.

And if you also sue for "rounded rectangles" and claim that this is an apple design and are stealing our customers.

Google, samsung, toshiba, acer, sony and other 7" andorid tablet makers can say apple are stealing our customers because when you see a 7" tablet you think of andorid.

If so, I hope apple gets sued.

Time they got a good taste of there own medicine.

'Super Bowl' the phrase is copyrighted by the NFL, the word 'Yup' and even certain parts of our DNA!

I'm sure these silly companies will find a way to fight over colour ownership one day, if it hasn't happened already.

Well, Apple's practically trying to oust its competitors by patent bullying, I see no reason why anyone shouldn't do the same to Apple as well. Even though I own a couple of Apple products, I do sincerely hope they get their piece.

So if your printer malfunctions and makes purple cards instead of megenta, can you get sued and then intern sue the printer maker?

Here in Iowa there's a small farm machine company called Kinsey. They take your equipment and paint it the color of your tractor. A couple of years ago John Deere took Kinsey to court. Kinsey won because they used a different color combination.

Only singing it as a public performance (restaurants, concerts, movies, et cetera) falls under copyright law. You can sing it at family gatherings and parties, royalty-free. That's why restaurants use their own birthday song concoctions.

I think very simple designs, words, and marks already in establishment are free from US copyrights and patents. You can't copyright a circle or square, for example. Neither can you claim the word "the" or something already in widespread public use. Something must already be an original construction in its own right, without being obviously derivative of another work, either.

And this is where things can break down somewhat; on one hand, standards make advances in technology interoperable and more accessible, also arguably more economical. On the other hand, this sometimes makes enforcing copyright and patent laws tricky...at some point, there's a blur of distinction and originality.

I suppose once something becomes so widespread in usage, that popularity has embraced an object or technology, it's very difficult to set hard limits on where uniqueness begins and ends.

I believe that ultimately all of these court cases by Apple are just going to slow down progress. It's like Ford taking Chevy to court over the use of a steering wheel!
 
Funny how some industries (automotive and aviation) promote technology sharing between companies while in the electronics industry companies sue each other left and right for menial things...

Not really, they are necessary to protect intellectual property, and what's wrong with that?

I have a patent, along with a colleague, currently US/EU pending. We've spent tens of thousands of pounds - hundreds including the Patents/Trademarks/Copyrights, and 4 years of effort in designing, developing, manufacturering and marketing a product that is simple yet effective. Now that the thinking has been done, a company like 3M could rip it off in half a day with little effort, sell it globally, make a truck load of money, and what would we have to show for our innovation and hardwork... why is it 'terrible' for us to be able to stay in possession of our idea?

Patents have a rightful place in cases like yours - I think it is the fact that Apple have taken Samsumg to court for the shape of their tablets and phones, and the action of swiping to unlock a screen. Really? How many ways are there to wake up a touch screen?
 
The suits aren't really about those individual things. Much of the modern Android OS was created by Google after Google's directors, who were on the Apple Board of Directors, were present for private demonstrations of iPhone prototypes. They were allowed to see these prototypes because they specifically promised Jobs that they would not enter the phone market and would not compete with Apple, but instead would support iOS.

Around that time, Google took over the open-source Android project, which was a keyboard-based OS for Blackberry-style phones. A year or so later, the G1 appears, and it's nothing like the Android OS that had previously been seen, but is instead very similar to iOS.

The real reason Apple has gone so heavily after Google is that Google stabbed them in the back. These weird minor patent things are just means of pursuing them.

As for Samsung - newer Samsung phones are ripped off of the iPhone. This isn't speculation. There are internal Samsung development documents that were in the trial in which Samsung engineers analyze the iPhone, feature by feature, compare it to the original Galaxy, and describe how Apple's version is better and how their ideas can be implemented on the Galaxy phones. They even specifically discuss how to copy some of these features without getting caught and sued. That's what really lost the case for Samsung.

All I can say is this is my dads business (patent & IP protection) and hes defended samsung before...


Apple wont be sued on the size of the tablet- guaranteed.

While some of the things you said are true, you also know that after the cases in CA., with judge Koh(?), whose judement were all in favor for Apple (Ca gets huge taxes from Apple), all this judgement have been cancelled because there is no legal pavement on which this judgement have been taken. Which if you are mean, could tent to say the judgement was made to protect taxes

We also know that Jobs said that he would do whatever he can to break Google and Android phones. Stealing is something Jobs was not untouched from, Ask Woz, Jobs stole money from him when they were still a garage business. So much for the holy Jobs

And the design patent for the Apple Tablet is pretty stupid that we can all agree on.

Putting a Patent on rounded edges, what should the others do. put cutting sharp edges on their Tablets.
And a patent on a transparent face in front of a screen is even more stupid. And coloured icons, really?

And if you go look at Odyssee 2001, there are "tablets" in this movie, so Apple can say what they want, the shape of a tablet isn't original.

And while Patent are useful, there have been a lot of misabuse is the last decade, especially the 90-2000's.

And copyright right now is the biggest turd. it needs to be update to the digital time, it's simply not up to date anymore.

And then lets not forget all the patent trolls roaming around courts, hindering developpement of technology and putting millions in the trash. Remember the guy this year that claimed to have invented the internet and wanted to sue every company in the IT. Troll

and on the, you can't copyright, patent globally used items or word. Look at all the companies Apple sued because there was an apple in the icon or design, like NYC

Or Paris Hilton patenting : That's hot or whatever....
