It's a cop out because if you assess a penalty or not based on some prior decisions and circumstances dilutes the facts of the legality of the move. Is this move legal? If no, then its a penalty.
But that's really the point; at times it is deemed legal, because no penalty is issued, and then suddenly it is not.

It's bad for drivers and it's bad for fans, because it's impossible to understand why a move isn't legal here when it was there, when the move is functionally identical. Either all drivers should be penalised for it, or none should.

Speaking of Penalties
Wish they would stick to the track limits.
All drivers were putting 4 wheels off the track after turn 9.
