This is not particularly impressive. The emergency provision OSHA used has never been used for vaccination? Ok... that doesn't mean it can't be. The fact that this judge thinks that whether congress has the authority to impose such a mandate would make a hard question gives me pause when considering their legal analysis. It looks like the Court doesn't think much of the Biden mandate.

Just like me, the Court thinks this needs to be handled by Congress.
Here is another snippet of the ruling I found on Twitter.

Appeals Court Extends Block on Biden’s Vaccine Mandate for Employers
Lol at the bitter, ignorant reaction on display whilst meanwhile, information comes out every month that proves your last statement.Vaccine mandates should not be necessary.
Ironically, it's largely the behaviour of the very people that oppose them so vigorously that make them necessary.
The brief version: The gap in Covid’s death toll between red and blue America has grown faster over the past month than at any previous point.
In October, 25 out of every 100,000 residents of heavily Trump counties died from Covid, more than three times higher than the rate in heavily Biden counties (7.8 per 100,000). October was the fifth consecutive month that the percentage gap between the death rates in Trump counties and Biden counties widened.
Killing kids to own the libs.If this goes somewhere I'm going to be pissed:
12 more states challenge healthcare worker vaccination mandate
A coalition of 12 states sued the federal government Nov. 15 to block a CMS mandate requiring COVID-19 vaccination for eligible staff at healthcare facilities participating in Medicare and Medicaid programs.www.beckershospitalreview.com
As I've mentioned time and time again, when you work in healthcare you sign something before you're hired that states you'll remain up to date on ALL vaccines. If this suit is successful, chances are hospitals will have to drop this meaning no more compulsory flu shots among vaccines like polio, Tdap, and Hep B. The most worrying of that bunch is Tdap, especially in pediatric-focused healthcare systems since the "p" in that vaccine is for pertussis, or better known as whooping cough. Whooping cough is serious for young children.
As a result, this will lead to more hospital-acquired infections, especially in areas where anti-vaxx garbage is alive and well.
With ICU vacancies creeping towards 0, we're beating back the 4th wave with...The Netherlands is the first European country to reinstate restrictions this winter, despite 72.1% of the population being fully vaccinated. Pubs and "nonessential retail" will have to close from 7pm for the next 3 weeks.
Welp, I give it a month before we follow them given the state of our own health service.
Really sorry to hear this, my thoughts are with your family and yourself.I recently lost a cousin from complications due to Covid-19. Yes he was vaccinated, but his family believes he caught Covid back in February of 2020 and he never fully recovered. I do know that he had other illnesses as well.
We were informed this afternoon that booster doses for anyone over the age of 18 will be approved tomorrow.Just called to schedule a booster and apparently normal people under 65 are not eligible yet? Guess I'll wait...
She said they were following CDC guidelines. I just called the same place I had the originals done which was a small pharmacy/ doctors office thing in a Safeway. 😅We were informed this afternoon that booster doses for anyone over the age of 18 will be approved tomorrow.
COVID-19 booster doses could be authorized by Friday, 'should be a priority' for US adults, experts say
The CDC said it's safe to mix vaccine brands, and data suggests Pfizer-BioNTech or Moderna would be more protective than a second J&J shot.www.usatoday.com
Even if it isn't, it seems like some states are keen on ignoring the CDC and FDA. Our governor said in a public address today that all Utahns over the age of 18 are eligible tomorrow. They're not doing a fantastic job of informing the health systems though, so I'm still trying to get a handle on just what they're talking about.
Regardless, talk to your doctor, but you likely fall into a "high-risk" group if you work outside the home.
Like mine. Colorado is still in something of an outbreak, so the argument is that the state is high risk. When normalized by population, Colorado and Utah are about neck and neck, and only a handful of states are doing worse than us (I count 7).Even if it isn't, it seems like some states are keen on ignoring the CDC and FDA.
Have you heard that this is not going to be pursued?if any
No, only inferred from the remarks of Iversen.Have you heard that this is not going to be pursued?

It's going to be interesting if it goes all the way to the Supreme Court because its ruling could have quite the consequences on the world's public health. If for some reason they ignore historical cases, its ruling could make all compulsory vaccinations illegal. This would mean no required vaccinations for schools, health systems, government offices, and the like which could very make once uncommon illnesses common again.Fate of Biden administration's vaccine mandate for employers now at conservative-leaning appeals court
The Biden administration's vaccine mandate targeting businesses with more than 100 employees is now before the conservative-leaning Ohio-based 6th US Circuit Court of Appeals, which could soon decide its fate.www.cnn.com
Everything looks like it's moving forward through appeals. It's not a matter of pending "further litigation", it's currently sitting before an appellate court. They would literally have to drop the case for nothing further to occur. That being said, if the court continues to block it (which I would expect), it seems unlikely to stop there.
When I filled out my form, there was an "are you eligible" question with a check box. Since the two examples they gave were healthcare and education, I checked it and they never asked when I went in for the shot.Just called to schedule a booster and apparently normal people under 65 are not eligible yet? Guess I'll wait...
I had all three of my shots at a small pharmacy in a grocery store.a small pharmacy/ doctors office thing in a Safeway. 😅
We're gonna need more Darwin Award trophies in that case. It's going to be interesting if it goes all the way to the Supreme Court because its ruling could have quite the consequences on the world's public health. At this point though, I fully expect it to happen though and we end up with a polio outbreak because people start going full anti-vax.
Probably need a whole new award for that one. Maybe name it after whoever signs their name first on the Supreme Court verdict. We're gonna need more Darwin Award trophies in that case.
