Wasn't it already known that the driver (Roger Rodas) was speeding, and the tyres on the Carrera GT were about 9 years old?


I'm unsure why she's suing when it wasn't actually Porsche's fault.

Putting tousands into making the Carrera GT charged but leaving the old factory tyres on :banghead: She should sue the owner, or APerformance, Rodas,...

It all comes down to the tyres. I will never understand how someone could be that careless driving such an high performance car on basicly dryed out tyres :nervous:

As I just explained, they're not blaming the car for the crash but for its actions during the crash.

Yes. But don't see that going nowhere either. The speed was around 180km/h? Side impact? Still astonished it didn't break his neck. Fuel lines, ESP, tensioners,... the safety devices on the car were probably on the pinnacle of what was possible back then. belts breaking pelvis and rips is better than spine? Or as what occured in some freak accidents, beheading! Heck the carbon monocoque design is one of the safest car builts. There is not a lot a car can do when hitting a small surface object at that speed. One could argue the fuel system sandwiched between passanger cabin and engine,... but then where to put it? In the front :lol:

As others mentioned, it's probably and sadly lawyers wanting to make money of the daughter. :( Sad
 
Considering most crash testing occurs around 40-65 km/h, and the car was going well in excess of 160 when it lost control and was still doing multiples of what any crash-testing regulation in the world requires when it struck, there's little chance her case will prosper.

Neither seatbelt tensioners nor fuel lines nor side impact protection beams are guaranteed to work properly in that kind of impact. In such cases, survival is the exception, not the rule.
 
Is anyone surprised that a seat belt brakes ribs when car hits something solid at 90mph+?

Seat belts will save lives and reduce injuries in crashes at 'normal speeds'. If you want to hit solid things at high speed you need a cage and harnesses.

Porsche lawyers already told the drivers wife it was his own fault (in so many words) and I'm sure they'll tell Walkers Daughter the same... it's the drivers insurance company she should be suing.
 
Indeed. And from experience, if you do any kind of performance driving, a racing seat and a harness are a must. Even at merely the limits of what the tires can take (about one lateral gravity, give or take), you can already incur bruising from the relatively loose seatbelts. In a sudden stop, they can definitely break ribs.

And airbags can kill or maim you. Something to think about the next time you see a front passenger with their feet propped up on the dash. (I've seen pictures. They're not pretty.)

I find it ironic that the government requires you to locate little kids in the back seat of a car. Why? Because that same government requires the installation of a device that can and has killed kids in the front seat.
 
Well, in this case it is. It's Roger Rodas's fault.

I was thinking maybe oil companies for selling the petrol that the car used.
Maybe the organic matter that ended up becoming oil(can one sue nature?)

On a side note... I have real issue with my car insurance calling natural disasters "Acts of God"...

Has anyone ever tried taking an insurance company to court over the term "Act of God"? Surely the insurance company would have to prove that god exists in order for an act of god to occur and negate them paying out.

In an answer to the lawsuit, the car company said Paul was "a knowledgeable and sophisticated user of the 2005 Carrera GT" and it implied that he shouldn't have allowed the driver of the car, Roger Rodas, to drive so fast (police said speeding was the cause of the crash.)


I tried to ignore this story but Seriously? Porsche is actually blaming Paul Walker for his own death as a passenger. Claiming Paul should have "stopped Roger from driving so fast". The accident is very unfortunate indeed but this is of very poor taste for Porsche to claim a passenger should stop a driver from driving fast. I am at a loss of words for this honestly.

This excuse is used by police all the time.

If your friend is driving like an idiot, tell them to stop so you can get out or slow down.

Don't read too much into this. It's a lawsuit, the lawyers are going to throw everything in there but the kitchen sink. Everyone knows it was the drivers fault but you can't answer a multi-million dollar lawsuit with, "It's the drivers fault". You have to cover all the bases.
