With EA. EA can however "lend" the license to others for a sum of money. EA and Sony are however not really hugs and kisses with eachother, so EA simply ask for too much money for the license for Sony to bite.

They already spent $80 mil on this game, another million dollars or so is just a drop in the bucket.

Unlike Brabus ( which indeed is a tuner ) Ruf is a certified manufacturer according to a rule in German law ( another one is Alpina ), both Ruf and Alpina get an unmarked chassis ( no chassis number attached ) and parts which they use as a base to build their cars and then attach their own chassis number to it.
This is only possible ofcourse due to the close relationship and respect both Porsche and BMW have for respectively Ruf and Alpina and vice versa.
Both work together in developing parts and share knowledge ( BMW for example uses a transmission on their own cars developed by Alpina ).
So although it may appear both these companies are tuners they're not as both are manufacturers in their own right and can therefore decide to give their licence to a game without consulting or asking permission for it by the "parent" company.
A Brabus is still a Mercedes-Benz ( a Mercedes chassis number ) even if it's badged a Brabus, a Ruf or Alpina however aren't a Porsche or BMW due to the reasons mentioned above.
Although technically they might be perceived as tuner firms by those unaware they strictly and legally aren't.

which really sucks because I'd love to drive the 917k and 917LH around the original Circuit de la Sarthe and the Mark Donohue 917/30 around Road Atlanta and Mosport.

In my opnion, there's nothing that could replace Porsche as a car manufacturerer. While a tuner might provide street cars that are, somewhat, an OK replacement, but there's nothing to replace the race cars with.

The only tuner I'd ever consider a worthy replacement is RAUH Welt, but since they're just that, a tuner, and not a car manufacturer like RUF, it's not gonna happen.

It can be unlocked with a Gameshark. It was modeled along with a Lamborghini Diablo race car, but was never actually coded in to the game as a prize or purchasable vehicle (couldn't get the licenses before release of GT3).
