Notice of Account Ban measures

All they have done so far is supposedly banned people with hybrids using them in the online ranked seasonal events. Nothing else

There are already so many of these threads. I feel like a broken record typing the same thing over and over.

Probably the most tiring part about all of this. Is the number of threads that pop up talking about the same thing.

*....clip...*Take my word for it or not. I don't have to prove it to you just look up the facts about the repeated jailbroken PS3s getting blocked over the last year and tell me that it is against the law/TOS to modify your system or game offline.

This is really not an attempt at having a dig at you Lock2Lock I'm simply stating that your interpretation of what is right or wrong appears to be incorrect. The plain fact is that you may not alter or amend either the platform or the game software under ANY circumstances. We do agree on one thing though and that's about not arguing as I really don't want to make any enemies over this. I and others have stated the facts about the position over modifying software, you may not do it, it is not yours to amend, you have only licensed it from the producer (PD/Sony) under very strict terms of use. These are not my rules, I'm just pointing them out based on what I know about software licensing and copyright laws.

As to what action Sony ultimately take, only they know that but this statement from them should be taken as a very clear warning that it's time for those involved to stop modifying the game and I for one am glad they have taken action.

It seems some people are forgetting about this bit:

"Please be aware that usage of illicitly modified game data and any mischievous conduct against other players using such data are strictly prohibited, and will be subject to penalties as soon as they are found."

Haha, you all need to chill out, guns don't kill people, people kill people.

Hacked cars don't ruin online rooms, people ruin online rooms.

I for one have used hacked cars (online) for completely realistic purposes and only when drifting.

I have never cheated a seasonal or any competitive race / event ever.

This crack down on hacked cars will just make the game less customisable for people that used it properly, and thus boring.

I only think people using hybrids in Seasonals and TT`s will be banned....

@Tornado I'm sure you believe that is both constructive and demonstrative of something but I completely fail to see the point.

I really do not want to get into a debate about the ToS and where they apply with you.

But if you do not want to believe what i am telling you fine by me. I just want to clarify as to where they in fact do apply online.but if you do not go online you can make it run windows for all i care it doesn't mean you are breaking the ToS.

As a example of offline breaks in the ToS.
Say if you did jailbreak your PS3 and you have some kind of problem and you need to send it into Sony for a repair ok. You send it in and some how they find out that you have moded the hardware/software your warranty is void and they will just send it back to you because they will not service it. That is a example.

Anything offline you own it. You could modify it in anyway you like as long as you do not bring it online. If you sell off information regarding code or mass produce it in anyway that is where the legal aspect of it comes involved.

You get what i am saying now?

That's where you're wrong.

Well, you're right about the terms of service, they are only valid for PSN, so if you're not using PSN then you can't break the terms of use.

But, the game is still protected by copyright laws. When you bought the game, you bought the license to play the game, you did not buy the rights to the game. "All unauthorized access is prohibited", as it says in the small print on the back of your case.

Agreed 100%. I was initially reluctant to hack any cars, however after I made my first few, I realised it's the most fun I've had in GT5 for well over a year.

GT5 offline is boring and too small with pointless AI
GT5 Seasonals got boring after a few months with the chase the rabbit races
GT5 online is flawed with poor coding, lag, idiots and noobs and the same cars dominating PP races.

With hacked cars, it was something new to enjoy. You could create a truly unique car. Realistic hybrids added greater variety to races and allowed replicas of real cars to be made.

'GT5 The Real Driving Simulator'
Part swaps are part of a real driving experience. A part that until recently Gran Turismo was missing.

And if someone say that hybrids are not real so shouldn't be part of GT5:
Red Bull X2010/2011- Not Real
FGT- Not Real
Polyphony Go Karts- Not real
GT Super Touring Cars- Not Real
RM Cars - Not Real
TC Cars - Not Real

Is this a 4th thread about hybrid discussion or a confirmation list of who has been banned?

Probably more than that. I wish people would look up other threads with the same topic before making so many but oh well

I was on last night building some 3-Rotor swapped RX-8's with no problem. I don't use my cars online though, so I'm not worried at all. In fact I have some more cars I plan to build tonight...

I have seen all the other threads, this one isn't to discuss the ban of hacks.

LIst of who has been banned, but that probably wont happen.

Thats the thing we dont really know if we are on grounds to be banned. PD say they are banning the players who have used there hybrids online or not.

I have used my hyrids online but I have never used them to cheat on Time Trial events. So I don't really know what to expect.

Yeah but like I said when you are not online those do not apply to you. It has and always will be a huge loophole in the TOS. They cannot do anything about it anyway so that's why i brought up the whole jailbroken PS3s and HOW they are dealt with by Sony.

My point is that if modification of the programming of video game software for personal use was illegal under copyright law (and Nintendo certainly argued fiercely that it was under the "creation of derivative works" clause in 1990), there wouldn't have been (several) products sold on the open market for 20 years that did exactly that.

...snip... and yet I just signed in online, and went into a couple of lobbies to check. No problems at all.

So obviously this is not a generic, "if you ever used a hybrid online you are banned" type of deal. I suspect it only applies to anyone that used cars in TT's and other offical PD events and has nothing to do with generic online play in open lobbies or lounges, but only time will tell.

For now, it's business as usual. 👍👍 Sorry non-hybriders...:grumpy:

I've already gone online without any problems. It's not a generic ban. Mark my words, we'll all by happliy hybriding on and offline next week.👍👍

I concur with the feeling that it's only those who have been foolish enough to use hybrids on the online Seasonals and TimeTrials that will get banned... because that is easy proof for PD to see who has done it.
