Just read this article: EA Invokes First Amendment Protection for Video Games in Trademark Dispute with Helicopter Maker

"Electronic Arts is asking a federal judge to rule that it has a First Amendment right to depict real-life military helicopters in video games such as Battlefield 3 without the permission of the aircraft's maker.

The action, basically a pre-emptive lawsuit against Textron, the parent company of Bell Helicopter, comes after discussions between the two sides broke down, according to a copy of the suit obtained by Kotaku. The suit was filed Friday in federal court for the Northern District of California.

The lawsuit says that on Dec. 21, Textron lawyers demanded that EA cease its depiction of three Bell aircraft in Battlefield 3. "The parties have been unable to resolve their dispute," EA's complaint says. "EA therefore has a reasonable and strong apprehension that it will soon face a trademark and/or trade dress action from Textron." Read more...

I strongly dislike EA, but how does this make them evil? It doesn't really sound like they've done anything wrong, as long as they aren't branding the copters. Likeness is used all the time in different art forms, and as the article states EA has won previous cases similar to this. We will see though.
 
There's guys on here who will pay a full price games worth for old tracks ported over.

Theres guys on here who will pay for DLC that they don't even like. Just to show support for any content.

Pretty sure PD could sell Porsches to the fans. They sold them a 14 mile straight after all.

US Giant 1 own Ferrari Licence
US Giant 2 own Porsches Licence
Both American giants find common ground to S@#w Japanese Giant 3

I wouldn't be surprised if next EA NFS games get some Ferraris ....

its a just a case of sony and pd not willing to pay the amount EA and porsche are looking for.

To me the choppers looking like a 1 to 1 copy of the originals. Even their names are nearly identical. And helis, like all the other vehicles are essential for a Battlefield game. :sly:

If it would be that easy, then we would have already 1 to 1 copies of Porsche's etc. in GT5, named f.e. "Tekart - GT Street R Concept '10" or something like that. :lol:
 
Let's say PD got the license as well, would they all have to be premium or would you accept a mix of premium/standard?

That wasn't relevant to this thread two months ago when it was first posted. The two situations aren't comparable in the slightest; especially not when the Porsche licence is cut and dried and the EA helicopter situation (which EA may very well win) hasn't even been decided yet.
 
I seriously hate EA for 3 reasons. D:<

1. The monopoly on Porsches and other car licenses in the past and present. I so wanted to play with M3s and Porsches on GT3 but they were only on crappy NFS games. Even now these F^&*S

2. The NFL license. Seriously who else thought the best football games were the 2k series? Madden makes them so much F%^&*ING money but face it the game isnt innovative. Barely anything changes year to year. Let's hope next year 2k13 comes back.

3. Tech support, origin, and servers. I can't play BF3 online for PC since they released a new patch. I email them and get no response what so ever. I put in so much effin time in that game and I can't play it no more. I spent a good 6 or 7 hours out of my life trying to figure out wtf is wrong. I give them my money and they F%^& me over.

ok im done.......

Im thinking about getting an xbox to get forza but I need to get a new wheel since it doesnt support my logi g25 just because of porsche.

If you want to blame anyone for that, blame the NFL. It was them that decided to make the licence exclusive, not EA. EA was just the ones who ponied up the most money to buy it after it was made that way.


EA even tried to get out of it earlier than they originally decided last year when the lockout was still likely, and the NFL extended another year rather than give EA any money back.
 
How do you guys feel that once again forza will get Porsche again and we won't? I really think it's time for a "ruf" / Porsche tuner pack that gets around the license like gt4 did.
 
EA have strong partnerships with Sony and MS... they have to to reach the maximum audience. I can't see why PD couldn't do the same deal with EA that Turn 10 did...if they wanted to. How can EA give the deal to MS and not Sony? PD sell a ton of GT games... they can afford it through future DLC pricing. And Kaz is a Porsche fan so you would think they would find a way for him to get his GT3 into the game.

The only issue I see is it takes PD much longer to model cars than Turn 10. Still, if they wanted to work the deal, they could sell 3- 4 DLCs over the course of the same amount of months... each with a few key Porsche cars in it. That would bring in quite a bit of cash for PD. It would get mine

When Porsche said they wanted to be in GT but were restricted by their contract with EA. I read that somewhere, could be false I guess.

If T10 gives EA Ferrari, what do PD have to offer?

Nothing. As far as i know PD has no exclusiv Manufacture license. They have some cars exclusiv.

Apart from the little fact that you have zero evidence that this means that PD couldn't negotiate for a Porsche licence.

Oh and MS doesn't own the Ferrari licence past titles that appear on the 360, which is why GT5 has Ferrari's (as does Ferrari Challenge, etc), so not quite a monopoly.

MS has made Deals with Sony for years now. For example Vaio, etc.

They dont hate each other like some fans do :)

PD (Sony) have probably tried many times, but the terms might not allow or they can't/won't fork out the money MS is willing to, MS are known for paying big for exclusivity of content.
Plus MS now are making two seperate games that will include Porsche so it might now be worth it for them to cough up what EA want for the license.

Wrong. Turn10 can put EA under pressure with the Ferrari license and a former MS staff is working for EA now.

Good to hear that Porsche is coming soon and the Cars were modelled before FM4 released.

You are the one that is wrong... Test drive Ferrari is about to be released on the PS3 and Xbox and its not published by Microsoft. It is a Ferrari licensed product.
 
One day hopefully Porsche will make it into GT, until then there are plenty of other cars that PD should be able add not to mention cars that were cut from previous games
