Was listed as "having 10" and "1" sold at my time of purchase. Now it says 4...now 5 sold and "more than 10 in stock".

I wonder how many they have.

I don't know but I'm going to try and order one.

Wonder if they will kick the order back and refund the 40. Surely a mistake.
 
Yea, I couldn't pass it up either, under $53.00 shipped. Might as well see what happens.

It shows 9 sold now with 10 Available - only one left.

I received this message also, right after I placed my order for another MobSim shift plate :irked:.
 
I'm not agreeing to anything. This is ebay not their own web store we have a contract at the agreed rate.


There aren't any terms on the page that says they aren't responsible for typographical errors and the default ucc rule is that unilateral mistakes, are not grounds for rescission by the mistaken party. I am curious to see what bs angle they use to weasel out of this.

Yeah I wouldnt agree to that either. I would file a complaint with ebay. They took your money. They want you to agree to get out of it.

From what I've read on eBay the seller may cancel and refund your funds and you really have no recourse if funds are refunded . The thing is, if you don't agree to the cancellation I believe the seller gets charged a final value fee (which they don't get charged if you agree).

I doubt mistake in price is a type of mistake ebay was thinking of. Otherwise any auction I list that didn't go as high as I wanted is a mistake.
 
Had my mother order mine while I wasn't around a PC. Calling her now to ensure she doesn't agree to their messages. She pretty eBay savvy so I'm sure she will fight with them over it. LoL
 
I tried to open a case on this but eBay will not allow me to open a case until after the item has had time to arrive. This is the message I received when I tried to open the case:

The item is probably on its way.Please allow enough time for the seller to process and ship your item.If you still haven't received the item by Oct 21, 2012, please contact us.You can also try contacting the seller.

Any suggestions on how to proceed?
 
I ordered the shifter at the alleged "mistake" price as well. I got the same message. I still don't see any "mutual agreement" sent to me on my ebay account. Where would I find that? I also don't see where they refunded me the money. Nothing about it in paypal. I'm not agreeing to anything. I paid the advertised price and now I want what they took my money for.
 
I can't believe you guys are actually trying to hold them to sending you that shifter. You obviously knew it was to good to be true and was a pricing error. If it turned out to be true then that's great. Why would you want to make someone give you something they made a mistake pricing and make them lose 100$ for everyone they sold.

It would have been different if the listing said SUPER SALE ON SHIFTER 110$ OFF RETAIL PRICE. They hadn't shipped the item yet or anything. If you had already received the item I would understand being upset about it. They obviously made a mistake that would have cost them a nice chunk of change to honor the listing. If it was me I would make sure I received my money back and just forget about it. There's no way I would try to take 90$ from someone just because they made a mistake on a price that I didn't have to travel anywhere or lose any money in making the transaction to receive the item. If this was a brick and mortar store and I drove an hour to go get the shifter after seeing the price advertised somewhere it would be different. But none of you are out anything so why should that person be punished thousands of dollars for a typing error.

I recently ordered a golf club online and they sent me 2 of them on accident. They didn't charge me for 2 just the one. I called them and told them their mistake. They couldn't even find in their system that they had sent 2 or that I received 2, but I had them send me a shipping label and told them to have the fed ex guy stop by and pick up the extra club. I could have easily just sold the club online and made a quick 150$ but I certainly wouldn't want someone to do that to me. If it doesn't cost me anything and hasn't inconvenienced me then I'm not going to complain over a minor mistake.

How is it an obvious pricing error? This is ebay, people frequently sell liquidated merchandise at below retail. The only question was the credibility of the seller and that question has been answered.

How are you so sure that it was a price mistake rather than a reaction to high demand and wishing they had priced it higher. It is common for an Ebay item from someone with a webstore to be lower as an example buy.com does this very frequently on items where the price on Ebay is far lower than on their own website.

I would bet had I not mentioned it here and the demand stayed as low as had been in the past, basically no completed listing with sales in the last month, it would have shipped. I've seen new th8rs on ebay go for 60 shipped, which is why I had this auto search set in the first place, so it is not implausible that they initially believed 57.63 shipped was a good rate for liquidating their inventory.

I've got no problems either way. If the price was legit and they shipped it. Fantastic. If they made a mistake and refund. Understandable.

With that they sent a refund with an explanation today. :( oh well back to my other cheap e brake idea.

I did the same for the Ferrari F1 rim back in February. I played $70 or so less including shipping from the German Amazon but it was on back order in the US. Amazon is great.
