Update: Brad Raffensperger, Trump Supporter > Brad Raffensperger, Never Trumper

Even if Raffensperger certifies the Peach State, Trump can still win easy. All he has to do is to convince the Republican-controlled state legislatures of Wisconsin, Michigan and Pennsylvania to throw out the current electors and replace them with Trump loyalists who will overide the "worthless" popular vote.

Isn't this what they call a putsch?

I think you've got to have decent beer to call it a putsch.

From the Reuters Article:
language in the U.S. Constitution that says each state shall appoint electors “in such manner as the Legislature thereof may direct.”

So in the event that no certification is attained and normal process is short-circuited, this state legislature process appears be perfectly constitutional, even though it has never been tried to my knowledge. I could be wrong. It certainly seems like a desperate long shot.

So can an American ELI5 why it's even possible for states to ignore their vote?

Why are the votes not just certified in each state and EC votes applied, end of?

There is a deadline for certification. It can't be done if it is under some sort of legal question or challenge.

It could be that if the deadline for certification cannot be met, then the panel of electors is dismissed and a new one is appointed by the state legislature.

They won't. If anything, they'll ignore the lack of people certifying and effectively "certify" over their objections. I don't think we'll see a state legislature ignore the state's vote. I'm not even sure it would be legal given that there are state laws about appointing EC delegates according to the vote. They would either have to break those laws, or pass new ones in a hurry.

Everything depends on the will of the legislature. I think they could even appoint themselves as electors.

Well as I understand it, it happened in 2016. The results were 306-232 but the final votes submitted was 304-227. All of the changes were to people other than Trump and Clinton and it made no difference obviously, but the fact it can happen seems bananas.

It all sounds dependent on whether Trump can find enough corrupt judges in those three states to declare the elections invalid and replace the electors so they can override the popular vote.

They may be able to find a legal loophole just large enough to force this decision through but you'd have to be totally oblivious to the optics of it to outside parties in order to try this.

In the terms of one wag I heard online... were it any other country than the United States attempting to subvert an election in this way, the United States would invade it and steal all their oil under the pretext of restoring democracy.

That was a bit different. That was faithless electors specifically mad at Donald Trump rather than an actual targeted effort to override popular votes in a state. Earlier this year the Supreme Court heard a case on that, and the ruling against Faithless Electors' rights to defy was so strong that I saw multiple places suggesting the idea of it possibly applying even to the handful of states that don't have such laws on the books.

In addition, Michigan and Minnesota specifically also have laws on the books saying that faithless electors' votes can just be thrown out; and Michigan Senate leaders have already said they aren't interested in just ignoring the Michigan popular vote because Trump wants it. The Trump campaign is just pissing in the wind trying to override the popular vote there.

It's a Reuters articles but the Yahoo link should be readable by all.

Brett Fryar is a middle-class Republican. A 50-year-old chiropractor in this west Texas town, he owns a small business. He has two undergraduate degrees and a master’s degree, in organic chemistry. He attends Southcrest Baptist Church in nearby Lubbock.

Fryar didn’t much like Donald Trump at first, during the U.S. president’s 2016 campaign. He voted for Texas Senator Ted Cruz in the Republican primaries.

Now, Fryar says he would go to war for Trump. He has joined the newly formed South Plains Patriots, a group of a few hundred members that includes a “reactionary” force of about three dozen - including Fryar and his son, Caleb - who conduct firearms training.

I'll repeat it for emphasis. Fryar says he would GO TO WAR for Trump. At this point it REALLY is a cult. Why would ANY American take up arms against their fellow Americans because of...HIM! To me it's beyond belief. A despicable, lying, cheating, grifting pig of a person. And this is the sort of blind fanaticism he has instilled in people?

A few other Gems...

In Sundown, Texas, Mayor Jonathan Strickland said there’s "no way in hell" Biden won fairly. The only way he’ll believe it, he said, is if Trump himself says so.

“Trump is the only one we’ve been able to trust for the last four years,” said Strickland, an oilfield production engineer. “As far as the civil war goes, I don’t think it’s off the table.”
:odd:

"There's millions and millions of Trump votes that were just thrown out,” said Hedrick, 70, a retired teacher and librarian. “That computer was throwing them out.”

"You are going to tell me 77 million Americans voted for him? (Biden) There is just no way," said Fontaine, 50.

“If I’m being manipulated by Trump ... then he is the greatest con man that ever lived in America,” Caleb Fryar said. “I think he’s the greatest patriot that ever lived.”
Well Caleb, you may be half right.

So far the states have expressed no interest in flipping for Donald. Let's hope it stays that way. He would have to take 2/3 of WI MI PA.

The deadline for states to certify is December 8 and the college should be casting their ballots on the 14th. From what cnbc says all court disputes also have to be settled by the 8th.

Just apropos of nothing, we've seen Mike Pence with a fly on his head, Mitch McConnell looking like the reanimated body of a car crash victim, and now Rudy Giuliani leaking pure evil after apparently speaking to Mr. Shadow two hundred years early.

Are they all hosting the Anubis goa'uld or something?

The only member missing from this seizure of power is Ronald Lacey.

Mr. Shadow! I couldn't remember the name when I mentioned the movie.

Edit: Raiders references are a surefire way to get a like from me.

Agreed. I've seen Republican politicians up close, and they were short, bald and ugly. Politics itself is like sausage-making, something you don't want to see too close up, mixed in with snot, hair, dead skin cells and sawdust.

I believe a few days ago, Mike Shirkey already said Michigan will not go to Trump. Hopefully he's not changing his mind.
LANSING — Democrat Joe Biden is the president-elect, and while Michigan’s Republican-led Legislature is investigating the election, it will not award the state’s 16 electors to GOP President Donald Trump, Senate Majority Leader Mike Shirkey told Bridge on Tuesday.

If he does after speaking to Trump, the President should immediately be investigated for interference.
